The Electricity Supply Act 1995 (NSW) allows the Minister to grant full or partial exemption from the Energy Savings Scheme in respect of any electricity load used by a specified person or in connection with a specified activity where the electricity load is used in an industry that qualifies as both emissions intensive and trade exposed.

This exemption is published in the Energy Savings Scheme (Electricity Load Exemptions) Order (Ministerial Order) which is published in the NSW Government Gazette.

The Ministerial Order applying to the 2019 compliance year.

The Ministerial Order applying to the 2019 compliance year was published in the NSW Government Gazette on 14 December 2018 and commenced 1 January 2019. The Order governs the calculation of exempt loads for the 2019 compliance year.

This version of the Ministerial Order is to be used by Scheme Participants when determining compliance requirements for the 2019 compliance year. Individual Annual Energy Savings Statements for the 2019 compliance year must be submitted by 30 April 2020. 

The Ministerial Order applying to the 2020 compliance year.

The Ministerial Order applying to the 2020 compliance year was published in the NSW Government Gazette on 13 December 2019 and commenced 1 January 2020. The Order governs the calculation of exempt loads for the 2020 compliance year.

This version of the Ministerial Order is to be used by Scheme Participants when determining compliance requirements for the 2020 compliance year. Individual Annual Energy Savings Statements for the 2020 compliance year must be submitted by 30 April 2021.
